Qacha’s Nek Magistrate Court Sentences Tlotlisang Thamae for Statutory Rape
In a recent ruling by the Qacha’s Nek Magistrate Court, Senior Magistrate Ts’eliso Bale sentenced 19-year-old Tlotlisang Thamae of Ha Rapase to eight years in prison for the statutory rape of his 13-year-old girlfriend. However, Thamae was given the option to pay a fine of M8000 instead of serving the full prison sentence. This fine is deferred until March 31, 2025, meaning Thamae remains free until that date but faces detention if the fine is not paid.
Magistrate Bale, in delivering the verdict, emphasized the gravity of the crime, taking into account the young age of the victim. The court found Thamae guilty based on the evidence presented, which included the circumstances of the case. Despite this being Thamae’s first offense, Magistrate Bale acknowledged his guilty plea, noting that it saved the court valuable time. The magistrate also underlined the importance of enforcing the law to prevent such incidents.
“The circumstances suggest a consensual relationship, but the law is clear on age limits,” said Magistrate Bale. He further explained, “Each year we face such dilemmas, but the law must take its course.”
Thamae’s charges were brought under the Sexual Offences Act of 2003, following an incident that occurred on June 16, 2024. This case serves as a reminder of the strict legal boundaries concerning age and consent, and the court’s commitment to upholding the law, despite the complexities of such situations.
